Who Can Apply for an EB-3 Visa? 

The EB-3 is a third-preference employment-based immigrant visa, and it’s available to various international workers, including the following:

  • Skilled Workers – Individuals capable of performing jobs that require at least two years of training or experience
  • Professionals – Individuals holding a U.S. bachelor's degree or foreign equivalent in a field required for a position for which they have a job offer
  • Other Workers – Individuals capable of performing unskilled labor for positions requiring less than two years of training or experience

Most EB-3 petitions require a permanent, full-time job offer from a U.S. employer and an approved PERM labor certification. This certification confirms that no qualified U.S. workers are available for the position and that hiring the foreign worker won't negatively affect the wages or working conditions of similarly employed U.S. workers. 

Employers specifically must show that they have the ability to pay the offered wage when filing for the certification.
